Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the MatchPix website, mobile applications, and related services (collectively, the “Service”), operated by Fireburd Productions (“MatchPix”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
MatchPix provides therapist-led, live speech-therapy game sessions and related practice activities. The Service is a tool to support speech and language practice; it is not a medical device and does not itself provide medical or clinical advice, diagnosis, or treatment.
2. Eligibility & Accounts
You must be at least 13 years old to create an account. Accounts are held by adults — either a licensed therapist or a parent or guardian. Children do not create or control their own accounts; they participate in sessions under an adult account holder’s supervision and responsibility. You agree to provide accurate account information, to keep your login credentials secure, and to be responsible for all activity that occurs under your account. Notify us promptly of any unauthorized use.
3. Responsibilities of Parents, Guardians & Clinicians
If you add a child to your account, you represent that you are the child’s parent or legal guardian, or a clinician authorized to provide services to that child, and that you have obtained any consent required to enroll the child and to allow their participation in sessions. You are responsible for supervising the child’s use of the Service. Clinicians are solely responsible for the clinical appropriateness and delivery of care provided through the Service and for compliance with the laws and professional standards that apply to their practice.
4. Subscriptions, Billing & Trials
Certain features require a paid plan. We currently offer Family and Therapist plans, as well as prepaid session-minute packs. Local, self-guided play may be available at no charge; live remote sessions consume paid or prepaid minutes. Billing is handled by our payment processor, Stripe. Current prices, plan limits, and included minutes are shown on our pricing page and during sign-up.
- Free trial. New subscribers may be offered a free trial (currently 7 days). Unless you cancel before the trial ends, your plan converts to a paid subscription and your payment method is charged automatically.
- Auto-renewal. Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel.
- Usage & overage. Plans include a set allowance of live-session minutes. Depending on your plan, use beyond that allowance may be blocked, may require a prepaid minute pack, or may incur overage charges at the rate disclosed for your plan.
- Taxes. Prices are exclusive of applicable taxes, which may be added.
- Price changes. We may change prices or plan features; we will give notice of material changes, and changes take effect on your next billing period.
5. Cancellation & Refunds
You may cancel your subscription at any time from your account settings; cancellation takes effect at the end of the current billing period, and you retain access until then. Subscription fees and prepaid minute packs are non-refundable, including any unused minutes. A free trial is offered so that you can evaluate the Service before you are charged. Where a refund is required by applicable law, or by the rules of the app store or payment processor through which you purchased, those requirements apply.
6. Acceptable Use
You agree not to:
- use the Service for any unlawful, harmful, or abusive purpose;
- harass, threaten, or harm other users, including children, during sessions;
- upload or share content that is illegal, infringing, obscene, or otherwise objectionable;
- record, reproduce, or redistribute a session without the consent of all participants;
- attempt to access accounts, data, or systems you are not authorized to access;
- disrupt, reverse engineer, or circumvent the security or usage limits of the Service; or
- resell or commercially exploit the Service except as expressly permitted.
7. User Content & Custom Cards
The Service may let you create or upload content, including custom cards and practice materials (“User Content”). You retain ownership of your User Content. You grant MatchPix a non-exclusive, worldwide, royalty-free license to host, store, display, and use your User Content solely to operate and provide the Service. You are responsible for your User Content and represent that you have the rights necessary to share it and that it does not infringe the rights of others or violate any law. We may remove User Content that violates these Terms.
8. Intellectual Property
The Service, including its software, games, artwork, animations, and default card and word libraries, is owned by Fireburd Productions or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.
9. Clinical Disclaimer
MatchPix is a practice and engagement tool and is not a substitute for professional clinical judgment, evaluation, or treatment. It does not create a therapist-patient relationship between MatchPix and any user. Decisions about a child’s care remain the responsibility of the treating clinician and the parent or guardian. If you have a medical concern, consult a qualified professional.
10. Third-Party Services
The Service relies on third-party providers, including Stripe (payments), Daily.co (live video), and Google/Firebase (authentication, data, and hosting). Your use of features powered by these providers may also be subject to their terms. We are not responsible for the acts or omissions of third-party providers.
11. Termination & Suspension
You may stop using the Service and delete your account at any time. We may suspend or terminate your access, with or without notice, if you violate these Terms, if your use creates risk or possible legal exposure for us or others, or as required to protect the Service or its users. Upon termination, your right to use the Service ceases; provisions that by their nature should survive (including ownership, disclaimers, limitation of liability, and indemnification) will survive.
12. Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
13. Limitation of Liability
To the fullest extent permitted by law, MatchPix and Fireburd Productions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, revenue, or goodwill, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless MatchPix and Fireburd Productions from any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your User Content, or your violation of these Terms or of any law or the rights of a third party.
15. Changes to These Terms
We may update these Terms from time to time. We will post the updated Terms on this page and, where appropriate, notify you. Your continued use of the Service after an update constitutes acceptance of the revised Terms.
16. Governing Law & Disputes
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in California, and you and we each consent to the personal jurisdiction of those courts.
